Șoșoacă și-a pus, singură, botniță.

Deci faptul că Șoșoacă și-a pus botniță e treaba ei.

Bill Cosby was released from prison Wednesday after the Pennsylvania Supreme Court overturned his 2018 conviction for sexual assault,

Let’s recap the events, as described in the NY Times article.

2004 – Ms Constand was raped by Mr. Cosby.
According to the 2018 sentence!
Please note that the Pennsylvania High Court didn’t say the 2018 jurors had ‘seen things”. Only that the trial shouldn’t have taken place!

2005 – The district attorney prosecuting the case “announced in a news release at the time that after an investigation he had found “insufficient” evidence. He later testified that he had given Mr. Cosby the assurance to encourage him to testify in a subsequent civil case brought by Ms. Constand. (A civil suit she filed against Mr. Cosby was settled in 2006 for $3.38 million.)”
As he was convinced he didn’t have enough evidence to make a penal case against Mr. Cosby, the prosecutor promised the defendant he will not be further prosecuted if he testified (a.k.a. ‘told the truth’) in the civil suit.
“In that testimony, Mr. Cosby acknowledged giving quaaludes to women he was pursuing for sex.”

2006 – The civil case was settled for $3.38 million. As in Bill Cosby agreed to pay that amount of money for something the prosecution wasn’t sure that it was able to convince a jury that he had actually done it.

2015 – The next district attorney reopened the case. And got a conviction. Despite the fact that the ‘main’ evidence had been provided by the defendant himself. Given after he was promised he wasn’t incriminating himself in a penal way.

2018 – Mr. Cosby is convicted for something he had done 14 years ago.

2021 – The Pennsylvania Supreme Court decides that Mr. Cosby had been practically duped into incriminating himself, found this to be unacceptable and released the former prisoner.

What are we, ordinary citizens, to make out of all these?

Be glad that our individual rights have been upheld?
It makes a lot of sense!
After all, upholding individual rights is what makes the difference between a free society and an authoritarian one.
Between people being free and finding themselves at the whims of the government.

Ask ourselves ‘what about the individual rights of the victim’?
That also makes sense.
But my experience of living under a dictatorship strongly suggests that letting some guilty people walk free is a small price to pay for making resonably sure that a government – any government, doesn’t accrue too much power over the individuals making up the people.

Ask ourselves ‘what happened to us’?
What drives so many of to use constitutional rights as loopholes?
Is this OK?

No legislation will ever be perfect!
That’s why verdicts are given by ‘peers’, judges are given so much ‘leeway’ and why, in general, the law is administered by highly trained responsible people and not by ‘machines’.

After all, how we use whatever we have at our disposal – legislation included, speaks more about ourselves than about the things we use and the circumstances in which we make our choices.

You might have figured out already that I don’t believe yet I find a lot of inspiration in the Bible.

I’d like to discuss today the subject of Eve.
Many people are adamant that she was instrumental in Adam being banished from heaven. That she was conned by the serpent into convincing Adam to commit the first – and most important, sin. Into disobeying God, his Father.
Hence Eve – and all her daughters, are the culprits for us, men, having to ‘toil for our daily food’. Outside of where we have been meant to live, the Paradise…

Really?!?

Then, if Eve was the root of all evil, why had God chosen Virgin Mary – Eve’s granddaughter, as the vessel for his beloved Son? For the instrument of our salvation?

Furthermore, if we treasure virginity – something which only man can spoil, then how come it is Eve – the entire womenfolk, who is considered the origin of sin?

Let’s move forward to the really hard questions.

Eve engaging in conversation with the serpent resulted in both Adam and Eve learning the difference between good and evil. In both Adam and Eve becoming full fledged, self aware human beings.
And what was wrong with that?!?
Becoming conscious was a bad thing? Thinking with our own heads is sinful?

I remember that, as a child, I had always experimented what was verboten. Except for the obvious things, of course.
And used the trick on my own son. Whenever I wanted him to try something, I led him to believe that that thing was dangerous or out of limits. For him, of course.

Given that sexes are, nowadays, considered to be equal… the advent of gender seems to be somewhat unwarranted.

I’m afraid things are not so simple.

First of all, sexes are only declared to be equal. Nobody – or, more exactly, very few, actually consider them to be absolutely equal.

Secondly, they are only of equal importance. Not at all ‘equal’.

First things first.
We, all, have been raised seeped in ‘culture’.
And almost all contemporary cultures consider women to be ‘second’ to men.
Hence both men and women – both raised by the same ‘mother’, have an ingrained bias towards men being ‘somewhat’ more important than women.

Last, but not at all least, sexes play different roles. Biologically, socially… any way you look at it, men and women do different things in order to fulfill their jobs. OK, those roles have been ‘blurred’ during the last decades but their are still discernibly different.
But of equal importance, mind you!

Just think of yin and yang. Would you say they are equal? Could you say which is more important?

Hence gender!
‘Genders’ do exactly that. They underline the functional differences between sexes while demonstrating the equal importance shared by both sexes.

And, last but, again, not least, genders teach us that only the biological roles are different AND fixed.
Social roles are also different but they can be fulfilled by either sexes. Men acting as secretaries for women bosses, women leading households – both income-wise and/or as ‘the pillar’, fathers using their maternity leaves, women flying fighting jets, men happily working as nurses. You name it!

You get accustomed to it.
Study genders. It will come easier.

“A person may choose to have an abortion until a fetus becomes viable, based on the right to privacy contained in the Due Process Clause of the Fourteenth Amendment.”

This was how the United States’ Supreme Court was reading the US Constitution in 1973.

Pro-lifers oppose this view. Their main argument being that life is sacred and needs to be protected. Period. For them, abortion equals infanticide. Plain murder.

What we have here is a clash of absolutes.
The absolute right to life and the absolute right to dispose of your own body.

The United States Supreme Court has solved the conundrum by setting a time frame. “until the fetus becomes viable”.
Pro-lifers propose another solution: “make abortion and attempted abortion felony offenses except in cases where abortion is necessary in order to prevent a serious health risk to the unborn child’s mother“. (Alabama’s HB314/2019)

Let’s see where lie the differences between Pro-Choice and Pro-Life.

Pro-Choice say that agency must be reserved for those who 1. are alive and 2. are directly implied in the matter.
Pro-Life extend the definition of ‘alive’ to cover everything they consider to be ‘living matter’ and thus take the final decision from those who are directly implied into the mater. And give it to those who have to decide the seriousness of the “health risk to the unborn child’s mother”.

In both cases the absolute becomes relative.
In the first case, the absolute becomes relative to the person directly involved in the matter.
In the second case, the absolute becomes relative to those powerful enough to insert themselves, and others, into the equation.

And both sides clamor they are acting in the name of individual liberty…

Regina Maria,
Ana Pauker,

Really?

Am I the first to understand that once you’ve eaten it, nobody will ever again be able to part YOUR cake from you?

It stops being a cake as you chew on it?

Well… yeah. Actually it does. But… it remains a cake in your memory! That’s what you’ll remember having eaten: A cake!

And now, that we’ve settled the ‘eaten cake’ problem, let me ask you another question.

How strange is it that so many conservatives consider taxes as an infringement upon their right to freely dispose of their property yet they have no qualms to impose their beliefs upon other people – women, to be more precise, denying them the right to freely  dispose of their own bodies?

Because all life is sacred!

Hence, in their view, all abortion is murder. Regardless of the age of the fetus. Regardless of the consequences of having an unwanted child. Too early, too many, not enough money, health problems, sexual assault… nothing counts except for the right of the fetus to be born.

Some go even further. They consider that contraception is murder too. Because it denies the right of the egg-cell to become an embryo…

As I said before.
It is not only possible but very normal to have your cake and eat it too.
Same goes for convictions.
Once embedded in our heads they become ours and nobody can part them from us, no matter what logical arguments might be involved. Invoked?

Except for us. We are the ones who can leave behind some of our old convictions and reach new ones.
Conversion is the name of the game.

A game we’ve been playing since the dawn of time.

Adaptare dupa Martin Niemoeller.

Men grow up ‘against’ their fathers.
Women grow up with their mothers.

Men try to ‘fix’ their relationship before the older one ‘grows out’.
Women don’t have this problem. By the time they have reached that stage of the relationship, they are beyond the point of no return.  Either not really speaking to each other or so ‘in sync’ that there’s no difference of opinion left to speak of.

Statistically speaking, of course.
For both genders.

‘You can’t beat a picture like this one.’
