While everything mentioned above is absolutely true, we must also remember that it was the whites – who had first reached the ‘proper stage of development’, who had given up slavery and invented ‘human rights’.
On the other side, it is also true that the whites did reach the ‘proper stage of development’ by exploiting the rest of the world.
Only ‘this’ wasn’t invented by them! I don’t want to go into the finer details. All of you know, very well, what had really happened ‘on the ground’.

What are we going to do next?

‘Delete’ everything the white people have contributed only because they have been the last to exploit the rest of the mankind?

Or accept the fact that evolution works in an oblique manner?

Regulations don’t really work unless they reflect the mindset of the majority…

And here’s how it works.

The rule about driving on the ‘right’ side of the road is observed without much need for enforcement.
Because the consequences are clear. And consistent, unless you drive a tank.

People had the same problem with condoms.
Until HIV came along…
Nowadays very few people engage in casual sex without one.

Give us time and … if SARS-CoV 2 will be around for long enough…

SARS-CoV 2 lock-downs have intensified the already heated discussion about ‘rights’. About “our rights”. Which have to be defended “at all costs”.

The way I see it, rights can be evaluated from two directions.
As ‘gifts’. Either gifted to us by ‘higher authorities’ or conquered for us by our ancestors.
Or as ‘procedures’. Elaborated in time by society and coined into law by our wise predecessors. Who had duly noticed that societies which respect certain rights work way better than those who don’t.

After all, societies are nothing but meta-organisms. Which, like all other organisms, function for only as long as the components interact according to certain, and very specific, rules. The ‘better’ the rules, the better the organism works.

In this sense, ‘rights’ are the code we use when interacting among ourselves. The rules we use when cooperating towards the well being of the society.

You don’t care about the society? Only about ‘your rights’?

OK, but if the society, as a whole, doesn’t work properly, who’s going to respect ‘your rights’?
Who’s going to help you when a bully will try to snatch ‘your rights’ away from you?
And bullies trying to separate you from ‘your rights’ are the most certain occurrence whenever societies cease to function properly.
Whenever the individual members of a society no longer respect each-other enough to collectively uphold their rights. Their rights.

Our rights.

Liberty is freedom from being constricted, in any way, shape or form. Period.

Liberty is more of an adjective rather than a verb. A situation more than an action.

Liberty can be attached to a space, to an agent or to both.

A free space would be a space where no constriction may occur, whatsoever.
A free agent would be an individual entity outside any constriction, whatsoever.

Mathematically, both definitions are possible.
Philosophically, both definitions are imaginable. By philosophers, of course.

Oscar Hoffman, a Teacher, kept telling us, his students, “For a proposition to be true it is not enough for it to be logically correct. It also has to make ontological sense. For those of you who don’t remember what ontological means, a true proposition must describe something which has to be at least possible”

In the real world, where there is no such thing as absolute freedom, liberty has to be first noticed/invented. And then constantly negotiated.

‘No such thing as absolute freedom?!? But liberty is a (God given) (human) right!!!’

Do you remember what Hoffman had (just) said about things which can exist in practice and things which can exist only in our minds?
Liberty might be a right – for those who enjoy it, but that doesn’t mean that everybody has it. And, even more important, that there is – or ever will be, something even close to absolute liberty.
If you don’t believe me, try to fly off a balcony without any ‘mechanical’ help. Or stop eating for a day or two. The Earth will surely ‘constrict’ you back towards its center and your stomach will certainly constrict itself for lack of food. And both Earth and stomach will constrict you back to reality.

‘OK, so no absolute freedom for individuals. How about ‘free spaces’?’
‘As in spaces where no constriction, whatsoever, may be exercised?’
‘Well, that would be possible. If a space is completely empty… no constriction might be exercised in there, right? On the other hand, as soon as something, anything, populates that space, constrictions start to appear. For instance, since no two things can simultaneously exist in the very same place, the mere existence of a speck of dust in a whole stadium induces the restriction that no other speck of dust may exist in the very same spot. Sounds trivial, true, but this is it… No absolute freedom. Not for individual agents and nor for spaces.’

‘Then why are writing a post about ‘Free market’? Doesn’t make much sense, isn’t it?’

Let me finish with liberty before going any further.
I mentioned earlier that liberty must be first noticed and then negotiated.
You see, right or no right, liberty is, above all, a concept.
We’d first observed that a flying bird is freer that a crawling worm and bam!!! We realized that some of us were freer than the others. Then that freer groups/societies fared better than the more ‘stifled’ ones.
But only where liberty was more or less spread around, not concentrated in one hand. Dictatorships – where all liberty is concentrated at the top, are way more fragile than any democracy. I’ll come back to this.
Now, for the negotiation part.
‘Your freedom to swing your fist ends where my nose begins’. And vice-versa. Only this is rather incomplete.
Let me examine the situation where you are a person who likes to swing your fist. In the air, not with any aggressive intent, of course. So you were swinging your fist, after you had determined, in good faith, that there was no nose close enough to hurt. But what if I am a ‘nosy’ guy? ‘Nosy’ enough to bring my actual nose inside your reach? You having to restrict your swings – or to go somewhere else, isn’t a limitation of your freedom? An absolutely unnatural limitation of your freedom?
Has it become a little clearer? What I mean by negotiation when it comes to individual freedom?

OK, time has come for me to go to market. To the free market!

A market is a place. Obviously, right?
A place where people trade their wares. Because they have noticed that it is easier for each of them to do what each of them do better and then trade the results of their work instead of each of them providing everything for themselves. As in everything each of them needs. Or fancy.

Initially, markets were far from being free. First of all, supply was sorely limited. Transportation means were practically nonexistent so supply varied seasonally and was severely influenced by weather, soil and other similar factors. And, maybe even more importantly, supply was influenced by the sheer will of the most powerful ‘free agent’ who happened to be around. Or, more exactly, supply was heavily influenced by the whims of the most powerful free-agent who happened to be around.
Don’t believe me? Then consider the extreme famine experienced by the Bengalis in 1943. Or by the Romanians during the last years of Ceausescu’s reign.
Slowly, people have learned that freer markets tend to be a lot more stable than the less free. ‘Freer’ markets meaning freer from both exterior and interior limitations. For a market to become free(ish) the participants need to have a big enough pool of resources at their disposal and to be wise enough to organize themselves in a ‘free’ manner.

And what happens when at least one of the two conditions remains unfulfilled?
Time has taught us that while markets tend to be limited in space and that some of the participants tent to impose themselves over the rest there is one dimension where the liberty of the market is very hard to be limited. ‘Liberty’ here meaning that things tend to evolve more in their own terms rather than ‘according to plan’. Or according to anybody’s wishes.

Whenever the available resources dry up, the participants to the market move someplace else. Or die of starvation.
Whenever a market looses too much of its freedom – as in some agent controls too much of what is going on there, the market itself no longer functions properly. Whenever too many of the participants loose their ability to determine their fate/future they slowly become ‘sitting ducks’. Not as much easy to hunt down but actually unable to feed themselves.
And since hunger is the best teacher, they either learn to fight for their freedom or… die of starvation. Pol Pot’s Cambodia would be a good example, even if somewhat extreme. The fall of most communist regimes also makes a compelling case for what I have in mind.
Even more interesting, though, is what had happened to the American Automobile Industry. General Motors and Chrysler Corporation, once the dominant stars of the market – along with Ford, had to be rescued by the government. Quasi monopolistic positions tend to be bad for the monopolists also, not only for the rest of the market. Given enough time, true enough…

In October, the District Attorney’s Office dismissed sexual assault charges against a nuclear weapons expert who formerly worked at Kirtland Air Force Base. But the Bernalillo County Sheriff’s Office didn’t release the man’s property, which included thousands of dollars of electronics and a draft of a book.”


They kept the kids in cages. And Excel spreadsheets. And more than 60 other government files and databases that made it nearly impossible to track the thousands of children who have been separated from their parents by the Trump administration while trying to enter the United States.

This is according to a new report released Thursday by the Department of Health and Human Service’s Office of Inspector General, which finds that, since 2017, the Trump administration has separated thousands more children from their parents than it previously disclosed and that it tracked these kids in ad hoc, disparate databases, including Excel spreadsheets and Microsoft Sharepoint accounts, further complicating the already tortured process of figuring out where those children are today.”

I have no first hand knowledge about any of these two separate ‘incidents’.
The first one might have been caused by a series of ‘misunderstandings’ while the second is only a portion of a hugely complex matter.

What really bothers me is what they have in common.

Both have been initiated by people belonging to/working for institutions put in place to protect the greater good of children. Children who are nothing but our future. Our only future.
Each of these ‘actions’ have been botched. By those who initiated them.
The institutions themselves had failed. To control the ‘runaway operators’ and to perform adequate ‘damage control’.

“Why are we doing things like these to our fellow human beings?”

Because we don’t consider them, in earnest, ‘our fellow human beings’?
For whatever reason?

There’s a seemingly unending debate about what “my liberty ends where yours begins” really means.

The initial saying was a little longer, Your right to swing your arm leaves off where my right not to have my nose struck begins.”, and had been coined during the disputes between those who tried to impose the Prohibition and those who opposed it.

In that context, it made sense.
‘How close to my house – a teetotaler, should you be allowed to open a bar and why should I be able to tell you what to drink/serve in your house.’

In a wider setting – individual rights, for instance … not so much!

‘Your right to swing your arm leaves off where my right not to have my nose struck begins’ only if at least one of the following is true:
– My arms are as long as yours AND I’m willing/able to defend my nose.
– You are a civilized person.
– We, the entire community, have reached the conclusion that we are better off, together, if we observe – and enforce, this rule.

The first proposition describes a situation of generalized conflict. Not necessarily ‘hot’ but, nevertheless, always waiting to happen.
The second depends, decisively, on the ‘other side’ behaving ‘properly’. Nice and commendable but what happens when someone goes berserk?
The third describes the de facto functioning of any civilized nation. Only a nation, any nation, is composed of individual people. ‘Endowed’ with ‘free will’ and not always ‘well behaved’.

Hence the danger of defining freedom as a collection of individual spaces where each of us might do as they please – as long as the consequences of their actions remain inside that space.
Which spaces would have to be constantly defended.
Or could be extended, whenever any of the neighbors wasn’t on the lookout.

How about ‘our mutually respected individual liberty is the well deserved consequence of our collective effort to enlarge OUR freedom’?

We pride ourselves for our ability to choose. Rationally!
We call that ‘liberty’ and we consider it an ‘undeniable human right’.

Yet everything, including our understanding of things, exists because of ‘chance’.
While neither chance nor choice can manifest itself/be exerted outside what we’ve learned to call ‘hard reality’.

In that simple statement is the key to science. It doesn’t matter how beautiful your guess is or how smart you are or what your name is. If it disagrees with experience, it’s wrong. That’s all there is to it.”

Until some two and a half centuries ago, there were two kinds of people.
Those who did, because they could, almost all that crossed their minds.
And those who had to suck it up, because that was all they could do.

OK, there had been, for a few millennia, a Middle Eastern religion whose teachings suggested that all humans had been created equal – because all of them had been made to resemble their creator,… but not very many people used to bother with this interpretation…

Then, all of a sudden, “We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. — That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed”

From that moment on, all of us have started to ‘have rights’. To express our opinions about things, to carry arms…

And we eventually made full use of those rights… by publishing porn magazines, by buying, for our own protection, AR-15s…

Some American states, Florida among them, have recently stated that people have the right to ‘stand their ground’. Or, more exactly, to defend the ground where they happen to be at any one moment. Using deadly force, if necessary. As if it that ground were their castle.

A few days ago, a guy had parked his car on a spot reserved for people with special needs. Right in front of a convenience store. He went in, accompanied by his five years old boy to buy something, leaving his woman and his other children in the car.
Another guy, apparently having ‘the right’ to park in that spot – the first one didn’t, came up and engaged the woman about the whole situation. The driver came back from the store, exchanged some words with the ‘challenger’ and then shoved him to the ground.
The challenger drew his gun and shot the offending driver, despite the fact that he wasn’t in any immediate danger – after shoving the challenger to the ground, the bully had retreated a few paces.

According to Florida statutes, what had happened was nothing more than ‘self defense’, a.k.a. ‘holding your ground’. Furthermore, the gun involved in the incident was registered and the owner had a permit to carry it around. No charges was pressed.

Which makes me wonder…
We have these “unalienable rights”… including that to ‘pursue our happiness’ … but do we really need to press them on… regardlessly?

The ‘bully’ parked where he was not supposed to because he wanted to buy an ice-cream for his toddler – I’m imagining things here, I confess.
The ‘shooter’ wanted to use his right to park there, so he confronted the woman he found in the wrongfully parked car.
The bully returned to his car and, perceiving a threat to his family, used his right to defend it.
The shooter eventually ‘stood his ground’ and walked scot-free…

You see, I not trying to make any fine point here. To contest the concept of ‘standing your ground’ or the idea of people carrying heat when shopping for groceries…

I’m just wondering… what happened to the concept of ‘rights’? Why some of us have arrived to see them as obligations?

The whole thing might have started as the deceased parked in the wrong place…. but if the shooter had chosen to call the cops instead of confronting the guy… he wouldn’t have had to shoot the ‘bully’ in front of his children….

His therapy, or “thorapy” as The REAL Bark team calls it, consisted of acupuncture, hydrotherapy, laser therapy, muscle building, and stretching. The most difficult part of recovery was helping end the enduring pain Thor was experiencing. Thor’s main doctor and biggest advocate was Dr. Jessica Waldman, the owner of California Animal Rehabilitation (CARE). When Thor attended CARE, the rescue team knew he needed a new set of wheels, a cart for him to pull his lifeless body along. Dr. Jessica Waldman surprised the team however with her response, “You can borrow a cart, but there is no need to purchase.” Thor’s doctor continued, “We will get him walking,” she said. “He wants to walk”. This hope kept the team going.”

“The scabies that infected Zeni’s body had become so severe that bacteria seeped into her bloodstream. She died in 2015 at age 93.

Zeni’s death is now the subject of a lawsuit filed against PruittHealth, a for-profit company that owns dozens of nursing homes, including Shepherd Hills in LaFayette, Ga., where Zeni lived for five years until she died. Shepherd Hills, a nursing home that had multiple scabies outbreaks in recent years and a history of health violations, failed to follow policies and procedures to prevent the occurrence and spread of the highly contagious disease, documents say. Instead of providing the care that Zeni desperately needed, the lawsuit alleges that the nursing home allowed her to die an agonizing death.

“The last six months of her life, she was in constant pain,” Prieto said. “She was literally being eaten alive from inside out.””

The American Revolution was fought under the banner of ‘Taxation without representation is tyranny”.
Meaning that the first Americans saw taxes as money well spent, as long as paying said taxes allowed them to vote. As in ‘being able to determine their own future’. Albeit in a collective manner.

In fewer words, the early Americans viewed liberty as being valuable enough to die for, let alone to spend some money in order to maintain it.

And what made so many modern Americans willing to sell their hard won ability to vote? To determine their future?

Are they so poor that, for them, liberty has become an empty word?
Have they lost all confidence in the democratic process?
Are they so infatuated with money?

Any mix of all of the above?
